Telegram court seeks CFTC opinion on tokens

A New York court in the ICO Telegram case appealed to the lawyers of the US Commodity Futures Trading Commission (CFTC) with a request to express their opinion on messenger tokens.

Within four months, the Securities CommissionThe US Securities and Exchange Commission (SEC) is trying to prove that the sale of Gramm in 2018 was illegal, since the tokens are securities that were not timely registered.

Telegram, in turn, insists that its tokens are not an investment instrument, and after the launch of the TON blockchain, they will actually becomea product like bitcoin or ether, because their value will be in the widespread use of instant messengers by users.

Judge Kevin Castell seems to have been convincedboth sides, and he decided to turn to the office of the CFTC chief lawyer with a request to express his point of view on this issue. Such a step could play into the hands of Telegram, since earlier the chairman of the US Commodity Futures Trading Commission Heath Tarbert said that cryptocurrencies fall under the jurisdiction of his department.

After deciding to seek an opinion from the CFTC, the judge also rescheduled the date of the first hearing in the case to February 19.
